Acceptable Use Policy
Effective
The point of these rules is that a real person trying to buy a ticket gets a fair shot at one. Everything prohibited here is prohibited because it takes tickets away from someone who queued honestly, or puts an event at risk.
This Acceptable Use Policy forms part of the Terms of Use and applies to everyone who uses the Service — buyers, attendees, Event Organizers, and event staff.
1.Fair access to tickets
You must not:
- use a bot, script, crawler, macro, browser automation, or any other automated means to search for, reserve, or buy tickets;
- buy more tickets than the published limit for an event, or try to;
- use multiple accounts, email addresses, payment methods, postal addresses, IP addresses, or false information to get around a ticket limit or a restriction;
- circumvent, disable, or interfere with any security measure, access control, queue, hold timer, or rate limit on the Service — conduct that is separately unlawful under the U.S. Better Online Ticket Sales Act, 15 U.S.C. § 45c;
- use a presale or discount code that was not issued to you, or publish a code beyond its intended audience;
- resell a ticket in breach of Transfer and resale; or
- do anything else that stops another person getting fair access to tickets.
2.Accounts and payments
You must not:
- create an account with false or someone else’s information, or create duplicate accounts;
- share, sell, rent, or transfer access to your account;
- use a payment method you are not authorized to use;
- file a chargeback for a valid purchase instead of asking us for a refund — see Chargebacks; or
- attempt any other payment fraud, including testing stolen card numbers against our checkout.
3.Tickets and entry
You must not:
- copy, forge, alter, or reverse engineer a ticket, a QR code, or the barcode format we use;
- present a ticket you know to be void, refunded, duplicated, or already used;
- sell, distribute, or publish a ticket QR code to more people than the ticket admits;
- interfere with the check-in application or with a device enrolled as a scanner, or enrol a device you are not authorized to enrol;
- use an event access code you were not given by the Event Organizer; or
- misrepresent an entitlement — for example claiming accessible seating or a companion place you are not entitled to.
4.The platform itself
You must not:
- scrape, crawl, mirror, frame, or systematically extract any part of the Service or its content, except that well-behaved search engine crawlers may index public event pages in accordance with our robots file;
- reverse engineer, decompile, or attempt to derive the source code of any part of the Service;
- place an unreasonable load on our infrastructure, or run a load test, stress test, or denial-of-service against it;
- probe, scan, or test the security of the Service except under our vulnerability disclosure policy;
- upload or transmit malware, or anything designed to disrupt or damage the Service;
- remove or obscure any copyright, trademark, or other proprietary notice;
- use the Service to send spam, harvest other users’ information, or impersonate anyone; or
- use the Service for any commercial purpose other than buying tickets for your own use, or selling events as an approved Event Organizer, without our written permission.
5.Content and conduct
Anything you submit — attendee names, answers to questions, support messages, and for Event Organizers, event listings and images — must not be unlawful, defamatory, obscene, harassing, hateful, deceptive, or infringing, and must not contain another person’s private information without their permission.
Event Organizers have additional obligations regarding the events they list and the content they upload, set out in the Organizer Agreement.
6.What happens if you break these rules
We take the least drastic step that reasonably addresses the problem, and we take a serious step immediately where fair access, payment integrity, or event safety is at risk. Depending on what happened, we may:
- warn you, or ask you to correct something;
- cancel a pending order, or decline a future one;
- void tickets without refund, where they were obtained or used in breach of this policy;
- suspend or permanently close your account, and refuse orders from you, from the payment method used, or from any account we reasonably believe to be associated with you;
- revoke a device’s check-in enrolment;
- block traffic from an IP address or network; and
- report the conduct to the Event Organizer, to a payment processor, or to law enforcement, and pursue any remedy available to us at law.
We are not obliged to refund fees on an order cancelled, or a ticket voided, for a breach of this policy.
7.Reporting abuse
Something wrong on the platform
Tell us at support@fomotickets.com — a fraudulent listing, a ticket being resold in breach of these rules, a message you should not have received, or anything that looks like an attack on fair access.
A security vulnerability
Please report it under our vulnerability disclosure policy rather than here, so it is handled confidentially and you are covered by the safe harbour set out there.
A copyright or trademark complaint
See the Copyright and DMCA Policy.
An emergency
If someone is in immediate danger at an event, contact venue security and local emergency services first. Tell us afterwards.
