Purchase Policy
Effective
The terms of the sale itself. Read this before you buy: it covers what you are paying, how your ticket reaches you, what happens when an event changes, and what your ticket does and does not entitle you to.
This Purchase Policy applies to every ticket, registration, add-on, and merchandise item bought through the Service — on our website, through an embedded ticket widget on an Event Organizer’s site, or at the door. It forms part of the Terms of Use, and terms defined there have the same meaning here.
Section 15 of the Terms of Use contains a binding arbitration agreement and class action waiver, with a 30-day opt-out.
1.Who you are buying from
We are a ticketing service provider. Except where an event page says otherwise, we sell as a limited agent for the Event Organizer: Vadelis Labs Inc. processes the transaction and collects payment on the Event Organizer’s behalf, and the Event Organizer is responsible for the event.
This matters in practice. The Event Organizer sets ticket prices, entry rules, age limits, and refund eligibility. If an event is cancelled or changed, the Event Organizer decides whether refunds are offered, and we can only issue refunds we are authorized and funded to issue.
2.Availability and your reservation
We do not control how many tickets are released, when they go on sale, or whether more are released later. Availability shown on an event page reflects inventory at that moment and can change while you are reading it.
Tickets are held, not reserved, while you check out. When you start payment, the tickets in your cart are held for a short, on-screen countdown so that nobody else can buy them while you enter your card details. If the countdown runs out before payment completes, the hold is released and the tickets go back on sale. Nothing has been charged at that point, and the details you entered stay on the page so you can try again — but the same seats or tickets may no longer be available.
A ticket is yours only once payment has been authorized and we have issued it. Adding tickets to a cart, starting checkout, or joining a waitlist does not reserve or entitle you to anything.
3.Prices, fees, and taxes
The total you pay is made up of:
- The ticket price (face value), set by the Event Organizer for each ticket type.
- Any add-ons you select, such as parking, merchandise, or extras. Some add-ons can only be bought together with a ticket.
- A discount, where you have entered a valid code, applied before fees and tax.
- A service fee, which may be a percentage of the discounted subtotal, a flat amount per order, or both. The service fee covers the cost of running the ticketing platform, payment processing, delivery, and support, and may include a margin for us or the Event Organizer.
- Sales tax, where it applies, at the rate set for the event.
Every one of these amounts is itemized and shown to you in full before you are asked to pay. We do not add charges after that screen.
Prices, fees, and tax rates for an event are fixed at the time you place your order and are stored with your order. If the Event Organizer changes the price of a ticket type after you have bought, that change does not apply to your order — and equally, we do not offer price adjustments, price matching, or partial refunds if the price later drops or a discount is later offered.
All amounts are in U.S. dollars. We are not responsible for foreign transaction fees, currency conversion, or other charges your card issuer applies.
4.Discount codes
- A discount code must be entered before payment. We cannot apply one retroactively to a completed order.
- Codes may be limited by total number of uses, by date range, by ticket type, or by minimum order — the conditions are set by the Event Organizer.
- A code that has reached its limit, expired, or does not apply to the tickets in your cart is rejected at checkout with an explanation.
- Codes have no cash value and may not be sold, published, or shared beyond their intended audience. We may void a code and cancel orders placed with a code obtained or used improperly.
5.Placing an order
When you place an order you agree to pay the total shown, and you confirm that the information you have given is accurate, complete, and yours to use. Do not place an order using false, incomplete, or someone else’s information.
Use one browser window or tab per purchase. Running several at once can create competing holds and cause your order to fail.
Orders are subject to card authorization, fraud screening, and other verification. We may cancel an order without notice — before or after you receive a confirmation — where payment is not received in full, where verification fails, where a payment is later recalled or reversed by the issuing bank, or where we reasonably suspect fraud or a breach of the Acceptable Use Policy.
6.Payment methods
Online, we accept major credit and debit cards, and — where the payment processor and your device support them — Apple Pay and Google Pay. At the door, we also accept cards through a card reader operated by event staff, and any other method the Event Organizer chooses to accept.
We never receive or store your full card number, expiry date, or security code. Card details are captured directly by our payment processor (Square or Stripe) in a payment field they control. We keep only the processor’s reference for the payment, so that we can refund it later.
Free registrations require no payment method. You still receive a confirmation and, where the event issues them, a ticket.
7.Order confirmation and ticket delivery
Once your payment succeeds you are taken to a confirmation page and we email your order confirmation and tickets to the address on the order. Tickets carry a QR code and are also available any time in your account under My tickets.
- Check your confirmation as soon as it arrives. Tell us straight away if anything is wrong.
- If you do not receive it within a few minutes, check your spam or promotions folder before contacting us. Delivery to your inbox depends on your mail provider, not on us.
- If our mail to your address hard-bounces or is marked as spam, we stop sending to it to protect delivery for everyone else. Your tickets are unaffected and remain in your account — write to support@fomotickets.com from a working address and we will re-send them.
- You cannot cancel an order because a confirmation email did not arrive. It is your responsibility to check your account and confirm whether an order went through before trying again.
Where an event does not issue QR tickets — some registrations and some door sales — your confirmation or receipt is your proof of purchase and admission is handled by the Event Organizer at the door.
8.Ticket limits and restrictions
Events may cap how many tickets one person, household, or payment method may buy. Where a cap applies it is shown on the event page and enforced at checkout.
Using multiple accounts, email addresses, payment methods, addresses, or automated tools to exceed a cap is prohibited. Where you do, we may cancel any or all of your orders and void the tickets — and where the tickets were obtained by circumventing a control, we are not obliged to refund the service fee.
Tickets may carry restrictions set by the Event Organizer: a minimum age, an ID requirement, a restricted view, a dress code, a specific entry window, or a requirement that an add-on be bought with a base ticket. Restrictions are shown before you pay. We are not responsible if you or your guests are refused entry for failing to meet a restriction that was disclosed to you.
9.Attendee names, questions, and waivers
Some events require a name for each ticket, ask questions at checkout, or require you to read and accept a waiver.
- Where a name is required per ticket, give the name of the person who will actually use that ticket. Staff at the door may ask for matching ID.
- Questions are set by the Event Organizer and their answers are shared with that Event Organizer. Do not enter information you are not comfortable sharing with them. See our Privacy Policy.
- A waiver you accept at checkout is a binding agreement between you and the Event Organizer. Where a signature is required you type your legal name; we record that name, the exact version of the waiver text you saw, and the moment you accepted it.
- Where you enter another person’s details, you confirm that you are authorized to do so and to accept any waiver on their behalf, and — for a minor — that you are their parent or legal guardian.
10.Errors
We work to keep event listings and pricing correct, but errors happen — a wrong price, a ticket type released early, an incorrectly processed refund.
Where we find an error affecting your order, we will contact you and either cancel the order with a full refund or offer you the chance to confirm it on the correct terms. Where we cannot reach you, we may treat the order as cancelled and refund it in full. This applies whether the error was human or a system fault.
Where a refund is issued in error or for more than you paid, we may re-charge the original payment method for the difference.
We are not liable for travel, accommodation, or other expenses incurred in reliance on an erroneous listing.
11.Line-ups, times, and venue changes
Advertised start times, running order, supporting acts, participants, and set lengths are set by the Event Organizer and can change without notice. No refund is due because a supporting act, participant, or line-up changed, or because an event started or ended at a different time than advertised.
Door times are not performance times. Late arrivals may be admitted only at a suitable break, and admission is not guaranteed.

12.Transfer and resale
Tickets are personal to the buyer and are not transferable through the Service. There is no transfer or resale feature: a ticket stays on the order it was bought on, and the QR code we issued is the only valid credential for entry.
- You may bring guests on tickets you bought for them, and you may give a ticket to someone you know. Where the event requires a name per ticket, that name must be correct — contact us before the event to change one.
- You may not resell a ticket above face value, resell it in the course of a business, or list it on a resale marketplace, unless the Event Organizer has given written permission and applicable law allows it.
- You may not use a ticket for advertising, a competition, a sweepstake, or another promotion without our and the Event Organizer’s written permission.
- We may void, without refund, any ticket we reasonably believe was obtained or transferred in breach of this section, and may refuse entry to the holder.
13.Protect your ticket
- Do not post a photograph or screenshot of your ticket on social media or anywhere public. Anyone who copies the code can use it before you do.
- We cannot tell who scanned a code first, and we are not liable for a ticket used by someone else after you exposed it.
- If you believe a ticket has been copied or misused, contact support@fomotickets.com before the event. We can void the old code and issue a replacement after verifying that the order is yours. We cannot do this at the door.
14.Attending the event
A ticket is a revocable licence to attend, not a property right. It may be revoked, and admission refused or ended, in the circumstances below — without refund.
- You must comply with the Event Organizer’s and the venue’s rules, including rules printed on or with your ticket and rules announced at the venue.
- You and your belongings may be searched on entry. If you decline, you may be refused entry without refund. Prohibited items typically include weapons, outside alcohol, controlled substances, professional cameras and recording equipment, laser pointers, and glass containers — the Event Organizer sets the actual list.
- The Event Organizer may refuse entry to, or eject, anyone whose conduct it considers unsafe, disorderly, abusive, or in breach of its rules, without refund.
- You assume all risks incidental to attending, including exposure to loud sound, strobe or pyrotechnic effects, weather, crowds, and communicable illness. Consider hearing protection. If you have photosensitive epilepsy or a similar condition, check with the Event Organizer about special effects before you attend.
Events are public and you may be photographed or filmed. By attending you consent to your image, likeness, and voice being captured and used by the Event Organizer and its partners in recordings, broadcasts, and promotional material, without payment or further permission, and you waive any related claim based on privacy or right of publicity. Where we ourselves organize the filming and you would prefer not to appear, tell us and we will take reasonable steps to accommodate you.
15.Check-in at the door
Tickets are scanned at the gate by staff using our check-in application. Have your QR code ready on your phone or printed; screen brightness helps.
The scanner can operate offline, so that entry keeps working when venue signal is poor. In that mode devices reconcile their scans with our servers as soon as they reconnect. In the rare case that the same ticket was scanned on two devices while both were offline, the earliest scan stands and the later one is recorded as a duplicate.
Where a ticket includes an entitlement that can be used more than once — a set number of drinks, rides, or redemptions — each use is recorded against the ticket and unused portions have no cash value and are not refundable.
16.Buying at the door
Where the Event Organizer runs a box office, staff may sell tickets and add-ons at the venue using the same system. Door prices, availability, and payment methods are set by the Event Organizer and may differ from online.
A door purchase is subject to this Purchase Policy in the same way as an online one. You receive a printed or emailed receipt; give an email address at the point of sale if you want your tickets in your account.
17.Waitlists
Where an event or ticket type is sold out you may be able to join a waitlist. Joining a waitlist:
- is free, and does not reserve a ticket or create any entitlement to one;
- means we hold your name, email address, phone number if you give one, and the quantity you want, so that we can contact you if tickets are released;
- does not guarantee that tickets will be released, that you will be notified in time, or that any will remain by the time you act on a notification.
You can ask to be removed from a waitlist at any time by writing to support@fomotickets.com.
18.Chargebacks
If something is wrong with your order, contact support@fomotickets.com first. We can usually fix it faster than your bank can.
Filing a chargeback for a valid purchase — rather than requesting a refund through us — is a breach of these terms. Where you do, we may:
- void the tickets on the disputed order immediately, including tickets already scanned;
- dispute the chargeback with the evidence of your order and, where applicable, of your entry to the event;
- refuse future orders from you, from the payment method used, or from any associated account; and
- recover from you any fee the payment processor charges us for the dispute.
19.General
We may update this Purchase Policy as described in Section 10 of the Terms of Use. The version in force at the time you placed your order governs that order.
If any provision of this Purchase Policy is unenforceable it is severed and the rest continues to apply. Our failure to enforce a provision is not a waiver of it. Headings are for convenience only.
