Copyright and DMCA Policy

Event pages carry artwork, photography, and descriptions supplied by event organizers. If something on the Service infringes your rights, this page tells you exactly how to get it taken down.
We respect intellectual property rights and expect everyone using the Service to do the same. This policy explains how to notify us of infringing material and what we do about it. It forms part of the Terms of Use.
1.Our intellectual property
The Service — its software, design, layout, text, and the TicketsByFomo name, logo, and marks — belongs to Vadelis Labs Inc. or its licensors. Your licence to use it is set out in the Terms of Use and does not include the right to copy, republish, or build on it.

2.Content supplied by event organizers
Event titles, descriptions, artwork, photographs, and logos on an event page are supplied by the Event Organizer for that event. Under the Organizer Agreement, every Event Organizer warrants that it owns or is licensed to use everything it uploads, and indemnifies us against claims that it does not.
We do not review uploads in advance. Where we are notified of infringing material, we act on it as set out below.
3.Reporting copyright infringement (DMCA notice)
If you own a copyright, or are authorized to act for the owner, and you believe in good faith that material on the Service infringes it, send us a written notice under section 512(c) of the Digital Millennium Copyright Act containing all of the following:
- A physical or electronic signature of the copyright owner, or of a person authorized to act on their behalf.
- Identification of the copyrighted work you say has been infringed — or, if several works are covered by one notice, a representative list of them.
- Identification of the material you say is infringing, with enough detail for us to find it. A direct URL to the event page or image is the single most useful thing you can give us.
- Your name, postal address, telephone number, and email address.
- A statement that you have a good faith belief that the use complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on their behalf.

- We review the notice for completeness.
- Where it is complete and appears valid, we remove or disable access to the material promptly — typically by unpublishing the affected event page or removing the image.
- We notify the Event Organizer or user who supplied the material, and give them a copy of the notice.
- We tell them how to file a counter-notice.
Removing an image or unpublishing an event page does not cancel tickets that have already been sold. Where an event is unpublished, we work with the Event Organizer on what happens next, and buyers are notified of any change under the Refund and Cancellation Policy.
5.Counter-notification
If your material was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice containing:
- Your physical or electronic signature.
- Identification of the material that was removed, and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, postal address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located — or, if your address is outside the United States, to the jurisdiction of any judicial district in which we may be found — and that you will accept service of process from the person who sent the original notice or their agent.

We forward a valid counter-notice to the original complainant. If they do not tell us within 10 business days that they have filed an action seeking a court order to restrain the activity, we may restore the material in 10 to 14 business days.
6.False claims
Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing — or that it was removed by mistake — is liable for damages, including costs and legal fees, incurred by us or by the party harmed by the misrepresentation. Do not send a notice or a counter-notice unless you mean it.
7.Repeat infringers
It is our policy, in appropriate circumstances, to terminate the accounts of users and Event Organizers who repeatedly infringe the intellectual property rights of others. We may also terminate an account after a single serious or wilful infringement.
8.Trademark complaints
The DMCA process above covers copyright only. For a trademark complaint — a mark used in an event name, logo, or description without authorization — write to support@fomotickets.com with:
- the mark, its registration number and jurisdiction if registered, and the goods or services it covers;
- your relationship to the mark and, if you are not the owner, your authority to act;
- a direct URL to where the mark appears on the Service; and
- an explanation of why the use is unauthorized and likely to cause confusion.
